1. About these terms
1.1 These terms apply to the Red Light Founding Membership (“the membership”) at Bionik Wellness, Suite 2, 410 Crown Street, Surry Hills NSW 2010. Bionik Wellness is operated by Gardenia Rose (ABN 39 630 213 955) trading as Bionik Wellness (“we”, “us”).
1.2 By signing up, you agree to these terms. Please read them before you join.
1.3 Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
2. The membership

2.1 The founding membership is limited to the first 50 members. Once 50 memberships are sold, the founding offer closes.
2.2 Your founding rate of $55 per week is fixed for at least 12 months from the date you join (see 3.5).
2.3 The membership cannot be combined with any other offer, unless we say otherwise in writing.
2.4 Members must be at least 16 years old. Members aged 16 or 17 need a parent or guardian to agree to these terms and pay on their behalf.
3. Billing and payment
3.1 You are billed $55 weekly in advance. Your first payment is taken when you sign up, then on the same day of each following week.
3.2 A valid credit or debit card is required. By joining, you authorise us to charge that card each week until your membership ends. No card surcharge applies.
3.3 If a payment fails, we will notify you and retry the payment automatically each day until it succeeds. Until the payment succeeds, you cannot book sessions. A failed payment fee of $5 applies once per failed weekly payment, however many retries it takes. Unpaid amounts remain owing.
3.4 You must keep your card details current. You can update them by emailing teambionik@bionikwellness.com.au.
3.5 Your founding rate is fixed for at least 12 months from the date you join. After that, we will give you at least one month’s written notice of any price change, and you may cancel before it takes effect.
4. Minimum term and cancellation
4.1 The membership has a minimum term of 12 consecutive weekly payments ($660 in total).
4.2 After the minimum term, your membership continues week to week until you cancel.
4.3 To cancel after the minimum term, tell us by email to teambionik@bionikwellness.com.au before your next weekly payment is due. Cancellation takes effect at the end of the week you have already paid for.
4.4 If you cancel during the minimum term, the remaining weekly payments up to the end of the 12-week minimum term are still payable.
4.5 You may pause your membership for up to 2 weeks in any 12-month period. To pause, email us before the payment for that week is taken. While paused, no payments are charged and no credits are issued, and your minimum term is extended by the paused weeks.
4.6 We may suspend or end your membership if you seriously or repeatedly breach these terms. If we end it, we will refund any amount you have paid for weeks not yet started.
5. Credits, booking and rescheduling
5.1 Each billing week you receive 3 session credits. One credit equals one 12-minute red light session.
5.2 Credits expire at the end of the billing week they are issued in. Unused credits do not roll over, have no cash value and cannot be transferred.
5.3 Sessions must be booked in advance through our online booking system. Bookings are subject to availability during opening hours.
5.4 To reschedule or cancel a booking, give us at least 24 hours’ notice. Late cancellations and no-shows use the credit.
5.5 If you arrive late, your session still ends at its scheduled finish time.
5.6 You may book a maximum of one red light session per day.
6. First week free after a single session
6.1 If you pay $70 for a single red light session and join the founding membership within 7 days of attending that session, your first weekly membership payment is free. We will give you a one-time code after your session to apply at sign-up.
6.2 Only your first weekly payment is waived. All later payments, including the rest of the 12-week minimum term, are charged at the normal rate.
6.3 The offer is available once per person, to new members only. It has no cash value and cannot be transferred.
7. Health, safety and suitability
7.1 Red light sessions are a wellness service. They are not medical treatment and do not replace advice from your doctor.
7.2 Before your first session you must complete our health questionnaire honestly. Tell us if anything in it changes.
7.3 Check with your doctor before using the red light bed if you are pregnant, have a light-sensitive condition, take medication that increases light sensitivity, have epilepsy or light-triggered seizures, or have a skin, eye or cancer-related condition.
7.4 You must wear the eye protection provided for every session.
7.5 Stop your session and tell our staff straight away if you feel unwell or uncomfortable.
7.6 We may decline or postpone a session if we believe it may not be suitable for you. If we decline your membership on health grounds, we will refund any amount paid for weeks not yet started.
8. General
8.1 Conduct. Please follow staff directions and treat the rooms and equipment with care. We may refuse entry to anyone who behaves unsafely or disrespectfully.
8.2 Privacy. We collect and handle your personal and health information under our Privacy Policy. Your card details are stored by our payment provider, Stripe.
8.3 Changes to these terms. We may update these terms. We will give you at least one month’s written notice of any change that affects your membership, and you may cancel before it takes effect.
8.4 Governing law. These terms are governed by the laws of New South Wales.
